Seller agrees to hold harmless and make no claim against Beth Zawodniak and
Anna Chamorro, the lessors of the space where the sale is held, any
volunteer, worker or paid participants in Smart Moms, or the insurer of
Smart Moms for the damage, theft or loss of any items consigned to Smart
Moms. Smart Moms does not anticipate any thefts, damage, or loss but
occasionally these events may occur.

Seller agrees to waive any and all claims for personal injury resulting from
participation in Smart Moms from whatever cause either foreseen or
unforeseen against Beth Zawodniak and Anna Chamorro, the lessor of the space
where the sale is held, any volunteer or paid participants in Smart Moms, or
the insurer of Smart Moms.

Seller gives permission that items with no price indicated on the tag will
be sold at a fair market price to be determined by the opinion of Beth
Zawodniak or Anna Chamorro. Seller agrees to accept this pricing as final.
If a price cannot be reasonably determined then the item will not be sold.

Seller agrees that items with no consignor number on the tag will not be
sold but will be placed in a LOST AND FOUND AREA at the end of the sale.
Any items not claimed from the lost and found by the designated close of the
pick-up period will become property of Smart Moms.
•
Seller agrees that unless the tag is marked "no discount", all items will be
sold at 50% of the price marked on the tag during the half price sale.
•
Seller agrees that any items not picked up by the end of the designated
pick-up period will become property of Smart Moms.
•
Seller agrees that any items marked “d” for donate will be donated to a
charity of Smart Moms’ choosing.
•
Seller agrees that no claims will be made against Smart Moms for any
discrepancies involving items placed in the sale.
•
Seller agrees to cash issued proceed checks within two months of the date of
the check. Seller proceed checks will be distributed within one month of
the sale's conclusion.
•
Seller agrees that the distribution of proceeds from the sale of each item
will be as follows: Sellers will receive 60 percent and Smart Moms will
receive 40 percent of consignors’ final sales. Sellers who work for a 2
hour shift at the sale will receive an additional 10%.
•
Seller agrees to pay a $10.00 registration fee (cash only) for the Spring or
Fall sales and $8.00 for the November sale at the time of drop-off.
